Point of sale. Demonstrators present in physical third-party stores to assist you with registering your machine and ordering coffee.

2. PERSONAL DATA WE COLLECT ABOUT YOU AND HOW WE COLLECT IT
Depending on your interaction with Nespresso (online, offline, via phone, etc.), we collect various types of information from you, as described below.
Personal contact information. This includes any information you provide to us that allows us to contact you, such as your name, postal address, email address, social media details, or phone number.
Login/account information. All information required to provide you with access to your account. Examples include your login ID/email address, username, password in non-retrievable form, and/or security question and answer.
Demographic information and interests. Any information describing your demographic characteristics or behavior. Examples include date of birth, age, gender, geographic location (e.g., zip code), preferred products, hobbies and interests, as well as household or lifestyle information.
Technical information about your computer/mobile device. Any information about your computer system or other technological device you use to access our websites or applications, such as the Internet Protocol (IP) address used to connect your computer or device to the Internet, the type of operating system, and the type and version of your browser. If you access the Nespresso website or application via a mobile device such as a smartphone, the information collected, where permitted, will also include your device's unique ID, advertising ID, geographic location, and other similar data about your mobile device.
Website/communication usage information. As you navigate through and interact with our websites or newsletters, we use automatic data collection technologies to gather certain information about your activities. This includes information such as the links you click, which pages or content you view and for how long, and other similar information and statistics about your interactions, such as content response times, download errors, and duration of visits to certain pages. These data are recorded using automated technologies such as cookies (browser cookies, flash cookies) and web beacons and are also collected through third-party tracking. Market research and consumer feedback. This includes information you voluntarily share with us about your experience using our products and services.
Consumer-generated content. Third-party social network information. Payment and financial information. Any information required to process your order or that you use to make a purchase, such as debit or credit card details (cardholder name, card number, expiration date, etc.) or other forms of payment (if available). In all cases, we or our payment processing providers handle payment and financial information in compliance with applicable laws, regulations, and security standards such as PCI DSS.
Calls to CRC (Customer Relationship Center). Communications with the CRC will be recorded and monitored in accordance with applicable laws for local operational needs (e.g., quality improvement or training purposes). Payment card data is not recorded. Where required by law, you will be notified of such recording at the start of your call.
3. COOKIES/SIMILAR TECHNOLOGIES, LOG FILES, AND WEB BEACONS

In addition to Nespresso/Nestlé entities and SF1 coffee d.o.o. or ad-hoc partners in the country (responsible for Nespresso's operations) mentioned in the Data Controller and Contact section (see Section 11), we share your Personal Data with the following types of third-party organizations:
Service Providers. These are external companies that help us operate our business (e.g., order processing, fulfillment, payment processing, fraud detection and identity verification, website management, market research companies, support services, promotions, website development, data analysis, CRC, etc.). Service providers and their selected staff are authorized to access and use your Personal Data on our behalf solely for specific tasks they are contracted to perform, under our instructions, and are required to keep your Personal Data confidential and secure. Where required by applicable law, you may obtain a list of service providers processing your Personal Data (see Section 11 to contact us).
Credit Reporting/Debt Collection Agencies. To the extent permitted by applicable law, credit reporting and debt collection agencies are external companies that assist us in assessing your creditworthiness (especially for invoice orders) or collecting unpaid invoices.
Third-party companies using Personal Data for their own marketing purposes. Except in cases where you have given your consent, we do not license or sell your Personal Data to third-party companies for their marketing purposes. Their identity will be disclosed when seeking your consent.
Third-party recipients using Personal Data for legal reasons or in the context of mergers/acquisitions. We will disclose your Personal Data to third parties for legal reasons or in the context of acquisitions or mergers (for details, see Section 4).
6. RETENTION OF YOUR PERSONAL DATA

Measures we expect you to take. It is important that you also play a role in keeping your Personal Data secure. When registering for an online account, be sure to choose an account password that would be difficult for others to guess and never disclose your password to anyone. You are responsible for keeping this password confidential, as well as for any use of your account. Please note that, under certain circumstances, we may not be able to delete your Personal Data without simultaneously deleting your user account. Terms of Sale Nespresso Croatia
1. Definitions
When the following terms appear in these conditions:
“Products” refer to the items sold by Nespresso.
“Nespresso” represents the company «SF1 coffee doo», distributor of NESTLE Nespresso S.A., based in Zagreb, Croatia, at Zadarska ulica 80. It operates as the “Nespresso” franchise holder for the Republic of Croatia, acting on its own behalf and account while using the “Nespresso” brand name.
2. General Terms
These general terms:
- (a) Govern all orders and purchases from Nespresso in any manner. For online purchases, please refer to our website for additional specific provisions.
- (b) Apply to your participation as a member of the Nespresso Club and the provision of Products and Services.
- (c) May be modified by Nespresso at any time by notification or publication on pages related to Croatia within the website www.Nespresso.hr.

3.2. The smallest coffee package contains 10 capsules.
3.3. For orders not placed in retail stores, each coffee order must be for at least 50 capsules and can include any combination of sets of 10 capsules.
3.4. All orders are subject to stock availability. Nespresso will notify customers as soon as possible of any stock shortages.
3.5. Nespresso reserves the right to fully or partially reject an order or request advance payment for the order if potential customers are found to have low creditworthiness.
4. Delivery and Acceptance
4. Delivery and Acceptance
4.1. Nespresso will make every effort to deliver Products and Services to the address specified in your order within two working days, except for islands and Dubrovnik, where delivery time may be longer. If, for any reason or due to force majeure, the aforementioned desired delivery time cannot be met, you will be promptly informed.
4.2. If you wish for the delivery of Products or Services to be carried out differently from the method provided by Nespresso, such a request must be submitted to Nespresso and, if accepted, you will bear all related costs.
4.3. Ownership of the Products and all associated risks are transferred to you at the moment the goods are handed over into your possession.
5. Return of Goods - Material Defects
5.1. You have the right to return defective goods within 15 days of receipt.
5.2. Nespresso accepts returns only for goods that are completely new and in their original condition and packaging, accompanied by the relevant invoices. Under these conditions, Nespresso will refund the amount paid for the returned products within 15 days of receiving such products. You will bear all postal costs related to the return of the goods.
For orders placed in retail outlets, coffee and food cannot be exchanged. Other items can be exchanged within 14 days with the receipt, provided the goods are not damaged or used.
5.3. You are responsible for checking the quantity and quality of the goods upon delivery. In the event of defective goods, you must notify Nespresso within 15 days of receiving the goods. If the product you purchased is genuinely defective, Nespresso may repair or replace it or refund your money in accordance with your legal rights. If you do not notify Nespresso of the defects within the legal timeframe, the order will be considered valid.

The seller is obligated to respond to the consumer in writing or electronically without delay, and no later than 15 days from the receipt of the complaint, providing an opinion on the submitted request and a proposal for resolution.
5.4. Nespresso Machines Warranty
Nespresso machines are covered by a 2-year commercial warranty provided by their manufacturers, in accordance with the specific terms outlined in the documentation supplied with the machines. For any questions regarding the operation, maintenance, or servicing of your Nespresso machine after purchase, please contact Nespresso at the following number: 0800 98 90 98 (toll-free).
5.5. Customer Rights in Case of Defects
If the customer has promptly and properly notified the seller about a defect, they are entitled to:
- Request the seller to remove the defect,
- Request the seller to deliver a replacement product without defects,
- Request a proportional price reduction,
- Declare contract termination.
5.6. Returns and Compensation
If the return is carried out properly, Nespresso will replace the returned product if it is found to be defective or refund the purchase price within a reasonable time frame, usually within 15 days of receiving the returned product.
6. Distance Selling Contracts
6.1. Ordering goods and services remotely, via the internet or telephone, is fully governed by the relevant provisions of the Consumer Protection Act.
6.2. You have the right to unilaterally terminate the distance sales contract within 14 days of the goods being delivered into your possession or the possession of a third party designated by you (who is not the carrier). The goods must be returned to us at your expense.
6.3. A sample form for unilateral contract termination, available on our website, can be filled out and submitted electronically. This form, along with the notification of your right to unilateral termination and the Distance Sales Contract, will be provided to you, no later than with the delivery of the ordered goods. Confirmation of receipt of the termination notification will be sent to you promptly via email.
6.4. Refunds will be issued within a maximum of 14 days from the receipt of the termination notice or, if the goods have been delivered to you, from the return of the goods or receipt of proof that you have sent the goods back.
6.5. The customer's right to unilaterally terminate the distance sales contract is excluded in cases specified in Article 86 of the Consumer Protection Act, if applicable to the contractual relationship with the customer.
6.6. Nespresso is not obligated to adhere to agreements or codes of conduct not established in law or other regulations that dictate business practices or consumer interactions, unless applicable and agreed upon by Nespresso.
7. Product Pricing and Payment Methods
7.1. Nespresso reserves the right to change the prices of Products and Services by notifying consumers in the most appropriate way.
7.2. You will pay the price of the Products and Services valid at the time the order is placed.
7.3. Prices include VAT but exclude delivery costs.
7.4. Free delivery is available for orders of 150 or more capsules, one machine, or one Aeroccino.
7.5. Payment Options:
- Cash on Delivery: The invoiced amount is payable in cash upon delivery of the Products or Services.
- Card Payment: During the purchase process on the website, you can pay using Visa, MasterCard, Diners, or Maestro credit/debit cards. The card must be authorized by the issuing bank for online payments.
All payments will be made in Croatian currency. The amount charged to your credit card will be converted from the price in euros to Croatian kunas based on the current exchange rate of the Croatian National Bank. When your credit card is charged, the amount will be converted to your local currency based on the exchange rate of the credit card associations. As a result of this conversion, a slight difference from the original price listed on our website may occur.

Bank Transfer Payments (For Legal Entities)

Deferred payments via bank checks are not accepted.
Address Discrepancies
If the delivery address differs from the billing address, the invoiced amount must be paid prior to delivery.
8. Membership in the Nespresso Club
8.1. By placing an order for Nespresso coffee, you automatically become a member of the Nespresso Club.
8.2. Your Nespresso Club membership number will appear on the first invoice you receive. Please keep this number for all future orders to ensure seamless service.
8.3. Membership benefits include access to special services such as updates on new products and services, participation in competitions, notifications about offers, and exclusive promotions.
8.4. Membership is non-transferable to third parties.
8.5. Members are responsible for ensuring their contact information with the Nespresso Club is accurate and up to date.
9. Liability
9.1. Nespresso’s liability regarding Products and Services is limited to what is explicitly stated in these Terms of Sale. All other liabilities are excluded to the extent permitted by law. Nespresso fully accepts responsibility for material defects in goods in accordance with the Croatian Obligations Act.
9.2. Nespresso assumes no liability (contractual, non-contractual, or otherwise) for any direct, special, consequential, or indirect damages, including loss of revenue arising from the sale described herein.
9.3. Nespresso fully respects consumer/customer rights as stipulated under the Consumer Protection Act and the Obligations Act.

11. Governing Law
These terms are governed and construed in accordance with the laws of the Republic of Croatia. Nespresso will make every effort to resolve disputes with customers amicably. However, if an amicable resolution is not possible, disputes between you and Nespresso will fall under the exclusive jurisdiction of the courts in Zagreb.

- iPROM: iPROM's cookie works by installing a cookie that displays personalized ads on other internet media after leaving the website. - IP addresses:
An IP address is a number that computers on the network use to identify your computer whenever you log in to the internet. We may retain IP addresses for the following reasons:
(i) troubleshooting, (ii) maintaining website security, (iii) better understanding the use of our websites, and (iv) better tailoring content to your needs based on the country you are in.
- Log files:
We (or a third party on our behalf) may collect information in the form of log files that record website activities and gather statistical data on users' browsing habits. We may use web beacons (or “clear GIFs”) on Nespresso websites. Web beacons (also known as “web bugs”) are small strings of code that deliver a graphic display on a webpage or in an email to transfer data back to us. Users can access and change their cookie preferences at any time by clicking the "Cookie Preferences" link on our website. This loads the cookie management tool operated by TRUSTe, which provides information on the types of cookies used on our website and allows users to opt-out of advertising and functional cookies to ensure compliance with international laws and regulations.
After a user selects the types of cookies they want to opt-out of and submits their preferences, the TRUSTe cookie management tool will ping all available opt-outs for cookies found on the Nespresso site. This cookie list is updated quarterly to maintain a complete list of advertising and functional cookies.

Order Process on the Nespresso Website
To shop on the Nespresso Croatia website, you need to be registered.
The registration process is simple:
Click on "Sign In" at the top of any page, then click on "Register".
A new page will open where you need to enter your first name, last name, email address, and password. Select whether you are a member of the Nespresso Club. If you are, enter your Nespresso Club membership number and postal code.
Check the box next to "I allow the use of my data and agree to the Nespresso Privacy Policy". Click "Continue".
On the new page, choose whether to register as an individual or a legal entity and enter delivery details. Fields marked with * are mandatory. Select the ways you want to be contacted and click "Continue".
In the next step, you have the option to register your coffee machine if you already own one. Select the model, color, enter the serial number of your machine, purchase date, and how you obtained the machine. Click "Register".
If you do not own a machine, click "Register".
You have successfully registered.
Shopping
Select the items you want to purchase. Next to each item, there is an "Add to Cart" button – click on it and select the quantity. The item will be added to your cart.
At any time, by clicking on "Cart" at the top of the page, you can see how many items are in your cart and their total price. All prices on the website include VAT.
If you wish to cancel the purchase of an item, click on the "X" next to it, and the item will be removed from the cart.
Once you have selected all the items you wish to purchase, click on "My Cart" and you will be redirected to a new page with your cart's content. If you have a Promo Code, you can enter it on this page. Click "Continue" at the bottom of the page. Confirm your delivery details, or enter new ones if you want the products delivered to a different address.
Currently, we only deliver using the Milšped delivery service within Croatia.
Here you can see the delivery costs for your order. The price includes VAT.
Click "Continue".
On this page, you can choose your payment method. If you registered as an individual, you can choose one of two methods:
- Cash on delivery - pay in cash to the courier upon delivery of your order.
or
- Credit card payment – by selecting this option, you will be redirected to the secure WS Pay portal for credit card payments and need to follow the instructions.
If you registered as a legal entity, you can pay for your order via bank transfer. Upon receiving your order, you will be sent payment instructions.
Click "Continue".
If you have any comments regarding delivery, you can enter them in the field on this page.
Accept the terms of purchase by checking the box next to "By clicking the button, you agree to the Terms of Use and Sale."
Click "Submit Order with Obligation to Pay."
Your ordering process is now complete.
A confirmation of your order, including a specification of the ordered products, prices, and delivery costs, will be sent to the email address you provided during registration.

Notice of Consumer's Right to Unilaterally Terminate Distance Contracts
You can unilaterally terminate the contract within 14 days without giving a reason.
To exercise the right to unilaterally terminate this contract, you must inform us of your decision to unilaterally terminate the contract before the deadline through a clear statement sent by mail to SF1 Coffee, Zadarska ulica 80, Zagreb, or by email to nespressoclub@sf1coffee.com, stating your full name, address, telephone number, fax number, or email address. You can also use the provided template form for unilateral contract termination.
The deadline for unilateral termination is 14 days from the day the goods that are the subject of the contract were delivered to you or a third party designated by you, who is not the carrier.
If you unilaterally terminate this contract, we will refund the money we received from you, including delivery costs, without delay and no later than 14 days from the day we received your decision to unilaterally terminate the contract, unless you have chosen another delivery method that is not the cheapest standard delivery we offer.
The refund will be made in the same way you made the payment. If you agree to another method of refund, you will not bear any costs in relation to the refund.
Please return or hand over the goods without undue delay and, in any case, no later than 14 days from the day you sent us your decision to unilaterally terminate the contract.
You must bear the direct costs of returning the goods yourself.
You are responsible for any reduction in the value of the goods resulting from handling the goods, except for what was necessary to determine the nature, characteristics, and functionality of the goods.
You can electronically complete and submit the unilateral termination form available on our website.
We will send you confirmation of receipt of the notice of unilateral termination of the contract without delay via email.
